Excuse my disgraceful illustration here guys!

Just come back from a gas safety and i have this query - Vertical flue from a room sealed boiler is 330mm away from the stack and about 610mm from the actual top of the chimney terminal. what would you classify this as? i was going to call gas safe but they are closed grr

MI's say 600mm away from another terminal, but is that where the stack terminal is or the stack itself? Not very clear to be honest
 
Class it as absolutely fine ? Stack isn't a terminal if not in use it's a vent , the consideration should be distance to a vertical obstruction to flue
