Does a window need to be atleast 30cm away from the base of the boiler flu (the part that comes out of the wall/opening) or the end of the flue where the fumes actually come out.

Our window opening is less than 30cm from the hole where the flue comes out, but the end of the flue is more than 30cm from the window opening.

Also the window has vents.

We are private tenants and we have tested for high carbon monoxide levels and my partner is pregnant.

These pipes above boiler were also boxed and screwed, and hasn't been opened on the last 5 gas checks

The wall to the left of the flu is a neighbors extension wall, what are the requirements for this?

If this is not legal what can be done?

Thanks in advance.
